Statutory Text
§ 1701. Short title of chapter.
This chapter shall be known and may be cited as the Motor Vehicle Financial Responsibility Law.
Significance for Pennsylvanian Drivers
For the ordinary Pennsylvanian driver, this section serves as an introductory point and sets the tone for the other, more detailed sections of the Pennsylvania Motor Vehicle Financial Responsibility Law. It lets drivers know that the ensuing law establishes standards and requirements for financial responsibility when operating a motor vehicle.
Significance for Pennsylvania Attorneys
For experienced Pittsburgh attorneys, Section 1701 is essential as it provides a reference to cite in briefs, motions, legal opinions, or in court. When dealing with issues of automobile accidents, insurance policies, or any related disputes, attorneys will need to be intimate with all the provisions of the MVFRL, starting with this section.
Advanced Analysis of the Language
Section 1701 uses a standard legislative drafting technique to designate the official title of the chapter. The language chosen is understandable and clear. The phrase "known and may be cited" sets a legal precedent that this is the standard reference for this legislative document. The simplicity of the sentence leaves no room for misinterpretation or misunderstanding, upholding the principle of legal certainty.
While this section doesn’t go into any specifics regarding the Motor Vehicle Financial Responsibility Law, it plays an indispensable role in understanding the overall context of the document. The title “Motor Vehicle Financial Responsibility Law” implies that the forthcoming provisions will pertain to financial obligations and potential liabilities of motor vehicle operators.
In conclusion, Section 1701, while simple, holds importance as the opening statement of the MVFRL, underpinning the necessity for financial responsibility while operating a vehicle. It is a foundational piece that, while not providing direct directives itself, indicates the overall direction of the law, thus providing essential reference to Pennsylvania attorneys and setting the stage for the rest of the policies outlined in this law.
